This chapter presents an assessment of some of the regions contributions to the global discussion of social rights. Several Latin American courts have developed arguments of various kinds for establishing social rights as enforceable rights. International law pertaining to social rights has played a significant role in these arguments. In Colombia, the right to a basic level of subsistence allows for legal protection through a writ of tutela, even when there are pending judgments or other legal proceedings in ordinary jurisdictions different from that of the Constitutional Court. However, in addition to protection strategies focused on minimum essential levels, decisions have been made in the region that extend beyond this modicum toward accountability for gradual progress in the realization of the rights and enforceability of their positive dimensions. In this regard, a ruling by the Constitutional Court of Colombia made a major conceptual clarification to overcome views arguing that judicial protection of political and civil rights has no economic impact. © 2016 Juan F.
